Rule 48
Provisions regarding appointment of representative

(4) If a licensee wants to appoint a representative in the country to which he has sent workers, he must submit an application to the department to disclose the personal details of the person proposed to be appointed.
(5) According to sub-rule (4), the qualifications of the person proposed to be appointed as a representative abroad shall be as follows:-
(a) Nepali citizens,
(b) Having at least a bachelor's degree,
(c) Not having been convicted of a criminal charge showing moral turpitude.
(6) Upon examination of the application received under sub-rule (4), if the request of the licensee is found reasonable, the department will allow him to appoint a representative in the country where the worker has been sent after taking a cash bond of two lakh rupees from him.
(7) If, upon examination of the application received according to sub-rule (4), it is not possible to grant permission to appoint a representative as per the request of the applicant, the opening department shall inform the licensee of the reason.
(8) The licensee shall provide the representative appointed in accordance with this rule with an identity card as prescribed by the department.
(9) The identity card issued according to sub-rule (8) must be renewed every year.
(10) Notwithstanding anything contained elsewhere in this rule, no person shall be a representative of more than one licensee.
(11) If a licensee wishes to remove any of his representatives, such representative may remove him as a representative by informing the department that he has changed his account book.
(12) If the licensee submits an application to get back the security deposit deposited by the licensee with the information that the representative has been removed in accordance with sub-rule (11), the department shall return such security.
(13) The licensee shall publish a notice in the national level newspaper every year, disclosing the name, surname and nationality of the representative appointed in accordance with this rule.
